All content on Nume Sites, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, documentation, code, and all other materials (collectively, the "Content"), is the property of Nume OÜ or its content suppliers and is protected by international copyright laws and treaties.

The compilation of all Content on Nume Sites is the exclusive property of Nume OÜ and is protected by international copyright laws and treaties. All software used on Nume Sites is the property of Nume OÜ or its software suppliers and is protected by international copyright laws and treaties.

Trademarks

The Nume name, the Nume logo, and all related names, logos, product and service names, designs, and slogans on Nume Sites are trademarks or service marks of Nume OÜ or its affiliates or licensors. This includes but is not limited to: the "NUME" name, the "nume" name, the "Nume" name, and any stylistic variations thereof (including but not limited to different capitalizations such as "NUME", "nume", "Nume", or "NuMe").

All other names, logos, product and service names, designs, and slogans on Nume Sites are the trademarks of their respective owners. You may not use any of these marks without the prior written permission of Nume OÜ or the respective owner.

Patents

One or more patents owned by Nume OÜ or its affiliates may apply to Nume Sites and to the features, products, and services accessible via Nume Sites. Portions of Nume Sites operate under license of one or more patents. Other patents pending.

License and Site Access

Nume OÜ grants you a limited, non-exclusive, non-transferable, and revocable license to access and make personal use of Nume Sites. This license does not include:

Any resale or commercial use of Nume Sites or their Content
Any collection and use of any product listings, descriptions, or prices
Any derivative use of Nume Sites or their Content
Any downloading or copying of account information for the benefit of another merchant
Any use of data mining, robots, or similar data gathering and extraction tools
Any reproduction, duplication, copying, selling, reselling, visiting, or other exploitation for any commercial purpose
Any attempt to decompile, reverse engineer, disassemble, or otherwise attempt to discover the source code

Any unauthorized use automatically terminates the permissions and licenses granted by us.

Content Ownership

You acknowledge that Nume Sites contain proprietary information and material that is owned by Nume OÜ and/or its licensors, including but not limited to the Nume Sites' visual interfaces, interactive features, graphics, design, compilation, information, computer code (including source code or object code), products, software, services, and all other elements of Nume Sites, and is protected by applicable intellectual property and other laws, including but not limited to copyright, patent, and trademark laws.

You agree that you will not use such proprietary information or materials in any way whatsoever except for use of Nume Sites in compliance with this Legal Notice. No portion of Nume Sites may be reproduced in any form or by any means, except as expressly permitted in these terms.

Disclaimers and Limitations of Liability

General Disclaimer

NUME SITES AND ALL CONTENT, MATERIALS, INFORMATION, PRODUCTS, AND SERVICES PROVIDED ON NUME SITES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. NUME OÜ EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND SECURITY AND ACCURACY, AS WELL AS ALL WARRANTIES ARISING BY USAGE OF TRADE, COURSE OF DEALING, OR COURSE OF PERFORMANCE.

NUME OÜ MAKES NO WARRANTY THAT: (A) NUME SITES WILL MEET YOUR REQUIREMENTS; (B) NUME SITES WILL BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE BASIS; (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF NUME SITES WILL BE ACCURATE OR RELIABLE; OR (D) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH NUME SITES WILL MEET YOUR EXPECTATIONS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NUME OÜ AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF NUME OÜ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (A) THE USE OR THE INABILITY TO USE NUME SITES; (B) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES; (C) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (D) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON NUME SITES; OR (E) ANY OTHER MATTER RELATING TO NUME SITES.

IN NO EVENT SHALL NUME OÜ'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE), OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING NUME SITES OR €100, WHICHEVER IS LESS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Applicable Law and Jurisdiction

These terms and your use of Nume Sites are governed by and construed in accordance with the laws of Estonia, without giving effect to any principles of conflicts of law. Any legal action or proceeding relating to your access to, or use of, Nume Sites or this Legal Notice shall be instituted in the courts of Estonia. You and Nume OÜ agree to submit to the jurisdiction of the courts of Estonia and agree that venue in these courts is proper in any such legal action or proceeding.

Indemnification

You agree to defend, indemnify, and hold harmless Nume OÜ, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of this Legal Notice or your use of Nume Sites, including, but not limited to, any use of Nume Sites' Content or services other than as expressly authorized in this Legal Notice.

Waiver and Severability

No waiver by Nume OÜ of any term or condition set out in this Legal Notice shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Nume OÜ to assert a right or provision under this Legal Notice shall not constitute a waiver of such right or provision.

If any provision of this Legal Notice is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Legal Notice will continue in full force and effect.

Nume OÜ reserves the right to make changes to this Legal Notice at any time by giving notice to users on this page. It is your responsibility to check this page periodically for changes. Your continued use of Nume Sites following the posting of revised terms means that you accept and agree to the changes.

Entire Agreement

This Legal Notice, together with our Privacy Policy, Cookie Policy, and Terms of Service, constitutes the entire agreement between you and Nume OÜ regarding Nume Sites and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding Nume Sites.
